Hi mel

dont know whether you have read my other post just wandering whether £13k would be a good F&F offer on my IVA which started 3 april 2008. The figures are £5400 fees and £10.5k to creditors, paid one payment of £265.00.

Hi there

I will look for the earlier post - but are you saying that your IVA was accepted in April 2008 and you want to offer a settlement now? If so, I do not think that will be well received by either your IP or creditors. Was the money not available to you prior to the IVA being accepted, and what is the source of the funding?

Hi mel,

My aunty won the lottery last Saturday 3 may. It is only a possibility. Forgot to say i have 4th year clause but currently £7k neg equity and we already have a 95% LTV mortgage interest only. So the house is never going to come into it.

Lucky aunt! Worth asking your IP about, to see if they would be prepared to put a variation forward, as creditors would get paid a lot earlier.

would you say £13k would be a fair offer given the short time of incuring fees?

It would appear that the offer would achieve the original dividend, so the offer level is sensible.

will let things die down and approach aunt, i will want everything above board though, i guess it would be best to get a solicitor to draw up a contract or would one between us be sufficient?

You don't need a solicitor for a simple contract like that, just draw something up, both sign it and get someone independent to witness the signatures.
