Hi..I have just recieved confirmation of an attachment of earnings taken out by the court re: unpaid council tax of £368. I have no other information about this...as in no forms to fill in. I am worried that:

a: will be IVA be ok...can I have an attachment of earnings order with an IVA

b. how much will they take if they've not sent me any papers to say how much I earn....??


Don't want my IVA to fail....was just wondering where I stand here.

hi and welcome!

i am no expert but do have some dealings with this in my job! if the council have been to court and obtained a liability order they can take payments from your salary to collect the amount outstanding, the amount they deduct depends on how much you earn as it will be a proportion of your salary that they take each month! not sure how it will affect an iva!

The debt will be captured under the IVA proceedings and the attachment should stop, albeit this may take some time to engineer practically.

Sorry can i just clarify has your IVA been approved and if so is it a post or pre IVA debt??

Hi Zoe

Yeah I've been in my IVA since Mar 2006. These debts are from 2006 and 2007/8. One is for £88 and the other is for £288.

sorry just to confirm...these debts are not included in the IVA....I should have included the 2006 one in the IVA maybe but wasn't aware I could and wasnt too sure if the debt is from 2005/6 or 2006.

As far as I know a copy of the order will be sent to your employers, they will then be legally required to deduct a percentage of the debt from your gross salary which will then be paid to the creditors, as Melanie rightly said this will be captured within the IVA once approved.

If it is post IVA then will be deducted by your employer - a personal question but if you tell me your take home pay i will tell you what will be deducted each week/month

I've spoken to the council and they say I have to pay the £368 over 2 payments. £280 + £88. Hardly seems worth all the hassle of involving employer but they will get their £££ and that's all they're bothered about.

The trouble my payment in June will be £147...this is april and may's payment as I was late paying...well they took it out my account on 21st april...and I thought it was set up for 1st of the month...hence I got charged as it sent me overdrawn and I don't have an overdraft obviouslt because I have an IVA. Therefore I was charged £30 for the pleasure. They said they are allowed to do this....hey ho.

I will therefore have the £147.00 payment (april and junes payment) plus they will take either £88 or £280 this month from my wages before I get them....or they will take £280 this month and £88 next month. The council..bless their souls are trying to get my employers to take ..£88 in June...£140 July and £140 in August. Either way I'm gonna be skint til at least September. Good job I have a v understanding boyfriend who is willing to help me out. I think i will doing a few car boots to get through this one...let's pray the weather is sunny in the next few wks.

My take home pay is in the region of £1650.

Under an Council Tax attachment of earnings order they are aloowed to implement 2 at any one time provided the minimum earnings threshold has not been exceeded (about £70 per week!!!)
Therefore they will take the FULL amount of both orders (plus a pound for admin costs per order) therefore the amount to be deducted will be £370.00 from your next pay packet

crikey. I was under the impression they would take it over 2 months from what the man said yesterday. I think I will contact them again and also my employers salary dept. I've got the funds available via my lovely boyfriend but I hate to take money from him!!

hey I think the council think I'm loaded...shame really...wish I was!! Oh well I will keep u updated...I called my IP and she was only concerned if the IVA was gonna go unpaid...er at this rate it will be but will talk to my bf this evening and see what we're gonna do. At least when this is paid it will be the last of my extra debt problems..had £170 gas to pay last month...i'm paying £25 extra a month on water arrears and Npower made me have a eletric meter fitted for a bill that was wrong..they said I owed them £500...then another one came for £900 and actually it was £125 when they bothered to sort it out!!!!!

I must admit worrying about money takes your mind off a million other things...but HOPEFULLY I will be sorted after the council are paid.

The annoying bit is it's my son's birthday on 1st July...will just have to sell something to buy him a decent pressie....anyone fancy buying a ball gown!!

Hi there
you may be able to come to an agreement with the Council who could perhaps ask your employer to deduct on one order at a time if it is going to cause you hardship speak to them and see what they say you can but try!
