i have successfully reclaime bank charges from the natwest and they refunded the money into a current account i havnt used for two years so i wrote to the bank and asked them to close the account and send me a cheque they have wrote back and said because i have a loan account with them they cannot close my current account but that loan account is currently included in my current iva what can i do?

Hi Cathy
Your refund of bank charges will have to be paid into your IVA.
Contact your IP and advise them of the windfall,they can contact your bank direct

For that reason, I'm not even thinking about trying to reclaim any bank charges. The bank has been stung enough with me going into a IVA at the end of the day.

Hi Cathy

Ive just read your post, i have considered claiming back bank charges but never really thought i would be able to now im in an IVA, how did you go about it and what information did you have to provide?

If i could claim the charges back (as there were many many of them) i could pay it into the IVA which would be great.

My boyfriend is with Nat West and he wrote to them about 9 months ago about reclaiming his charges. They wrote back and said that he wont get anything until the test case etc was all over. When did you receive your bank charges?

If you claim back your charges, surely the bank you claim them from will take them towards their loans? Or do they have to give them back to you first?

My iva company wrote to me about this when it first came about. They said a company could either offset it against what was owed or pay it over . Either way it was to be put into the iva and not mine to keep. They also said although banks were paying money over to remember that if I needed a variation then I would like the banks to look variably on my proposal which they may not if I'd claimed back my charges. I decided against it in the end as I didnt want extra stress on top of the iva especially when I would not be the one to benefit!
