Our IVA was originally agreed in June 2005 and since then, in February 2008, we had a further meeting of creditors where a lump sum settlement along with all contributions to date was accepted as full and final settlement of the arrangements.

Almost immediately, we received correspondence from Lloyds TSB chasing payment on two of the included accounts. In response, we wrote with details of our IVA and contact details for our IP - something we did numerous times back in 2005 when the IVA was being agreed.

We also forwarded these letters onto our IP who contacted them and reminded them that a settlement had been agreed and confirmed that the said accounts are included in our arrangement.

We have now received our completion certificate along with our final report but have also just received two Default Notices for the two accounts from Lloyds TSB.

We have again written with details of our IVA including, this time, a copy of our completion certificate. We have also forwarded them onto our IP.

Also, until now we have had no correspondence from them since the IVA was agreed in 2005 apart from monthly statements which continue to add interest to the current account. Again, copies have been sent to our IP and she has assured us that claims are submitted in respect of the balance as at our original meeting of creditors and as such statements showing accruing interest are disregarded when calculating dividends payable.

I just wondered if anyone had any further advice on how to deal with them? They are obviously in breach of the agreement and it's getting quite distressing. I know I'm probably worrying unduely but am getting quite upset with fresh threats of legal action and additional costs/fees being constantly added to the accounts.

I suggest that your IP speaks to KMPG who handle the Lloyds TSB account and ought to be in a position to deal with this. I find KPMG very helpful in circumstances such as this, where it is obvious that wires have been crossed, and your IP will know who to speak to there I am sure.
