Dear Forum
Just wandering if anyone know anything about the following...
I am currently considering entering into an IVA and also considering trying to reclaim back the bank charges which HSBC have taken from me over the last 6 years - if I were to be successful in getting the charges back from the bank, how would this affect the IVA? Would HSBC just knock that amount off the amount I owe them?

Hi
If you are already in an IVA when your claim is paid then the whole amount will go into your IVA.
It is also possible that HSBC will just reduce their claim by the amount of your refund

Ok thanks for the reply - I thought that might be the case!!!
If I do go ahead with the IVA, should I let the IP know about this?

I put my claim in a year ago..from what ive read the banks could draw the current court case out for years..so i wouldnt worry too much!

Ha - if that's the case and I do enter into the IVA maybe I will be out of it by the time they get round to paying people back!!!

my thoughts exactly. but, fees on our joint account for 6 years huge. My OH in IVA, i am not (in a DMP). If claimed charges back successfully, is it 50/50 so i could pay mine directly to frozen bank account and keep the change (to pay others) ??? whilst OH goes into IVA

I had a similar thing but they paid me directly as the left hand barely talks to the right. Fingers x'd happens for you too.
