If I have an IVA am I still able to be a headteacher in a primary school

Hello,
An IVA is a private agreement with your creditors. This means that no one else needs to be told about it. As a result there is never any publicity in the local papers about IVAs. If you set up an IVA your professional or employment status will not be affected.
However there is a social stigma associated with bankruptcy and they cannot be kept private because they are always advertised publicly. The bankruptcy announcement is usually published in your local paper along with your name, address and occupation.
If you are made bankrupt, then you are not allowed to be involved in promoting, forming or managing a company without the permission of the court.

You will need to check the terms of your contract of employment and find out whether your local education authority have a specific policy on this point.
My gut feeling is that you would be able to take up this position, but there is no right answer. Make the above checks to be sure!

As a headteacher of a primary school, it would be very unlikely that you would be prevented from undertaking an IVA. Melanie is quite right to advise that you check your contract of employment. However, I would be very supprised to see anything their which would prevent you from undertaking an IVA or indeed applying for the position if your are currently in an IVA.
If you are in the process of applying for such a role, is there any way you can get sight of the likely contact in advance? If not, I suggest you press on with the process but clearly check the Ts&Cs before signing the contract.

I would agree with the other experts that this is unliekly to be a problem for you however the only way to be 100% sure is to talk to the recruitment department or check the terms and conditions of your contract.

You can also contact your union and ask them. I assume you are a member of the teachers union.But for complete anonymity there is a website for teachers, but this one charges. However, they do have a freebie ' Ask 1 Question' where can ask them just 1 question and they respond to you within 48 hours. You could give them a try with your question.
