Does the IVA have to include all unsecured debt or can they be set up for each debt.

As far as I am aware all unsecured debts must be included, and it could cause your IVA to fail if you do not do this and make payments outside of the IVA. This would be construed as giving a particular creditor preferential treatment. I owed Next Directory £70 and I was going to pay it, but was told that it had to be included. Also, the more creditors you have, the more chance you have of your IVA being approved.

Skippy13, odd you should mention NEXT. I have NEXT as a creditor as well. They wanted payment out of me and I gave them the same exact reason you did as a refusal as I am seeking an IVA. GUESS what was said to me? My jaw dropped! The debt collector then said for me to pay them a certain amount *confidentially*.

I must admit I never contacted them - I left that to my IP. That is really bad - I wonder how much they are making by people actually making a 'confidential' payment? And I wonder how much of that actually gets to Next from the debt collector, or am I just cynical?!?
