I am now 2 years into my IVA. I have just received a letter from my IP saying i have to stump up another £673.96 in order to comply with my proposal due to earning more money within the last year.

What they havnt taken into account is that I have been working sometimes in excess of over 70 hours a week to cover overheads (like a broken car & large household bills) they do not seem particularly interested when i mention this & just say they will try and sort out a suitable monthly payment. They do not seem interested that the cost of living has increased dramtatically either over the last year!

However I cannot afford to pay any more money a month. I do not go out at all due to all my money being ploughed into the IVA. I admit i was foolish before and an IVA was the only viable option for me at the time. I thought it was all going great & only 3 years to debt freedom but now i feel i am being shafted (so to speak). Please can anyone offer any help. I live on my own and I do not have a socail life anymore because i cannot afford one. I just feel like i am getting deeper into problems again and need help so any suggestion would be very much appreciated. Many Thanks

I would write another I and E incluuding all the rises you have had and ring and ask to speak to the actual Ip. It seems so unfair, they should take into account your rises in livig. we are all feeling it a lot at the moment. My rent and utlities have gone up by £50 a month alone without any of the petrol council tax and water, so I think it quite reasonable for some leeway to be given from the overtime you have done.

Hi,

We were asked for 884.00 to cover my hubbys 50% bonus, although my wages had gone down by £180.00 per month and we had a lot of additional expenses. When I said we did not have it they said they would add it onto monthly payments over remainder of IVA, which worked out about £19.00 per month. They were not interested either, said would send direct debit form with additional payment amount. We have never received it, carried on paying original amount. Waiting to see what happens at annual review when I can supply evidence of additional expense and IP gets to see it.

Don't loose heart yet, as Ang says complete another income and expenditure and send to your IP, everyone is aware of the price rises of everything and they should be able to see from your i&e where your money is going and what you can afford.
If you have any reciepts for the work on your car let them hve copies of that also.
I admit to bein foolish before my iva and am nearly a year into mine and have found with careful plannng I can still have an active social life with my friends, just not going out for meals all the time like before but maybe buying a pizza and some wine and sitting in.

The forum has been an imense support to me and I would advise keeping in touch as you will get expert advise in addition to people who are in the same boat as you,

well i will just add to this and see if anyone can shed any light for me. I have been awaiting a call back all evening as they were to busy to talk to me yesterday. I just thought id call them again only to be told that the offices are now closed by an answering machine! how can i discuss my situation if nobody is prepared to talk to me. Quite frankly i think it is disgusting that they should be able to put this extra burden on me and then not be willing to discuss this. I am with Blair Endersby by the way so i dont know if anybody else has had a similar experience. I having been sat at work all day sick with worry as to where i will be able to generate any money from as all i earn is allocated out elsewhere so it is really far from comfortable as they say it should be! I must also add that during the first year of my IVA i was off work on statutary sick pay for 3 months which they are well aware of and had to borrow money from friends and family to cover my iva and all my other outgoings. Will they take into consideration that i have been trying to pay this back this year? they made no effort to reduce my payments during this time & statutory sick pay only just covered my monthly payment to them. If anyone can help me with this it would be gratefully appreciated. thanks in advance once again.

How frustrating it is when companies say they will call back and you sit waiting and nothing happens.
Anyway I would ring them again first thing in the morning and again ask to speak to the Ip or for the IP to call you i would wait until 430 and if noone has rung ring them again.
Blair Endersby do post on here so hopefuly someone will see it and give you some way to get through to someone who can help.
I totally agree that some consideration should be or have been given to your added expenditure.
Hopefully you will get through soon.

to ensure this does not happen, we pay any extra money across each month so as not to be in the position at annual review time.

also when we recently completed a new I&E we enclosed all receipts of car expenses and petrol and food bills so that they could see that we were not pulling the wool over their eyes.

My husband received a £3k payrise - they have said we do not need to add any extra to our monthly payment as our expenses have been jusitifed and certified by receipts etc - therefore we have £200 a month more money than we did at the outset of our IVA!

An IVA is supposed to be a manageable way to pay off as much debt as possible, to the best of the individual's ability to afford the payments.It is in the IP's best interest to keep up to speed with their client's financial situation, responding to any changes promptly.

IPs are meant to listen to their clients and understand if there has been additional exceptional expenditure during the year, which should then firstly be set against their clients' 50% share of additional income earned and then it there is still a shortfall against the creditors share. In my practice we monitor this every three months, to ensure that we understand what is happening with our clients financial circumstances, and that there are no nasty suprises at the year end. I am sure that if you send your IP details of the additional expenditure they will give this full consideration and probably agree some form of compromise with them.

well i have to say thanks for the message on here from blair endersby. well i rang them first thing this morning only to be told by the guy on the other end of the phone that it is all my fault i havnt read the terms properley and i should monitor any extra earning and pay them at the time and it is not their problem. they have told me i can pay it over 5 months but no longer which has bumped up my payment considerably. I was once again disgusted by the reaction from this guy. surely they are supposed to be here to help us in this situation. we all admit we have been foolish to get into this situation and require help & guidance as to get through it. I have never had anything to say that perhaps i should be thinking about this and to put some of this money to one side (and not spend it on things like vehicle maintenance. which i did myself as i cannot afford to pay a garage to do!) I am now looking in to moving back in with my mum so i can put all this money away for them as a single guy living on my own i cannot find this money in 5 months i was more that happy to spread it over a longer period but apparently this is not allowed. i offered a compromise but none came from the other end i just got a snotty its your problem response. I shall be emailing blair endersby regarding this as i was unhappy with this treatment i understand that i wil have to pay this fair enough but why wasnt i warned about this at the time when i earned it and not 6 months later! thanks all once again

I'm sorry you're not getting any help from BE. OK, yes you should have read the terms, but they don't need to point out the obvious, they need to help you come to a solution. I don't understand why you can't make extra payments at the end of your IVA. You could try contacting your IP direct rather than speaking to admin staff. You can find their email address on the Insolvency Service website - http://www.insolvency-service.co.uk/newipsearch.htm

You have the right to discuss this directly with your IP - but the infoline that BE use on this site for their own clients does appear to get things resolved very well. Give it a try I am sure you will get satisfaction - and I have to say that what your IP's staff member has said to you is probably correct - but there is a way that this can be dealt with in perhaps a more human manner into the future.

Well just to let you all know spoke to an IP today and he got it all sorted out for me! Blair Endersby have returned to their usual top quality service to help me out today. I would like to thank everyone on here for all their help & i will certainly be sticking around on this forum! Thanks Guys!
