I live in a Housing Association property and have rent arrears of £1500.00, could i still do a mutual exchange if i have an IVA?

I cannot see why not - but it is probably more a question for the Housing Association and not us!

Usually mutual exchanges are not accepted until any rent arrears are paid but as it a housing association they may have different ploicies so best to ask them first. It would be no problem with your IVA as long as you keep your IP informed.

In our area you cannot move house if you have rent arrears, they would not allow a mutual exchange either. As Mrs Skint states different areas may have a different policy.

i agree with lily.. could be a problem I know when I had council flat and wanted to exchange to house, we couldn't as other tenant had arrears

In Housing Law rent arrears cannot stop you doing a mutual exchange however, the Council or Housing Association can impose a condition that you have a clear rent account. Are the arrears included in your IVA? If so then the council or HA may have written them off your current rent account and put them as a sundry account (Ex tenants account) in which case your current rent account would be clear but each housing dept wll have different ways of dealing with this so you would have to check with them - If the arrears are still on your current tenant account then it would be highly unlikely they that would allow you to carry out the exchange unless you clear the rent arrears.

you cant exchange or mutually swap houses if you have rent arrears up here maybe different in other areas, you could always ask :)
