As some of you know my IVA is mostly down to business debts.
Anyhow, on Friday got a phone call from one of the companies who are based in europe, and he said the IVA wouldn't apply to him as he's not English! Is he correct?

WE had a very small debt (only about £60!) to a german company and we were told that could not be included as it was not in UK?
Don't know if this was right but for us it didn't matter since it was so small - sure an expert will be able to say though for sure - fingers crossed for you xx

I don't know what the answer is, but I am sure that Melanie or Andy will be able to answer your question.

Hey Suzanne, I don't the answer but I just wanted to say that I read your blog every day and it sounds like you're going through a nightmare. I really feel for you and I just want you to know I'm thinking of you. Sorry, I'm not much help. X

Hi
Melanie will correct me but I think that you will include this debt in your IVA and that they will be bound by it.They will be unable to take legal action once your IVA is agreed

Thanks everyone for the replies so far. I was confused as my IP has a list so knew about the foreign ones. And in fact one of the other companies had phoned chasing, and when I explained was fine. So this call really threw me.
Thanks Vicki, I actually enjoy writing it. Once I've got it in black and white it helps, if that makes sense! And finding this place has been a Godsend

Foreign debts can be included in the IVA, as your Centre of Business Interests in in the UK. Suzanne - can I nag you on here to return the proposals asap. We have called you a few times and left messages for you, and I do need to get them out to creditors.

Thanks Melanie, can breathe - yet again - for now!
All the paperwork is done, in an envelope to post tomorrow

Sorry, did speak to Angela, some of it took longer than others to sort out.
