Can anyone tell me if we can get a second opinion about our IVA? We have asked for a variation order to have the IVA payments reduced, but the figures we have been sent are confusing and although our parents being totally financially dependent on us was mentioned in the original IVA proposal, we have been told that because it wasn't mentioned under the liabilities we cannot claim for anything to do with them in our expenses. Apparently our I&E is only for the two of us and does not include my parents. There are other things as well whcih really don't make any sense to us. Non-preferred creditors amount never the same amount?

The relatinship manager's explanations don't make sense and I have to make photocopies of all accounts for the 3rd time as they have been "misplaced". How the hell the review was done without them - heaven alone knows.

Could someone advise please? So totally cunfussed!!!

Why are your parents financially dependent upon you Sharon, and how was this explained in the original proposal? This is quite unusual and should have been really highlighted at the time that creditors were first consulted.

You could seek legal advice as to the decision of your Supervisor, or take the matter to Court for a Judge to decided, but that could be quite costly. Which IP firm are you with?

Melanie I can send you the original doc to take a look at - if that is not unethical. As I've said in other posts their visa status doesn't allow them access to public fund and the little bit of pension they get allows them their dignity. They don't know we're in an IVA and bringing them over here (becasue of my Dad's ill health) is part of the reason why we are in financial poo. If they know that my Dad would probably have another stroke. I don't want to involve them in this at all.

By all means send me the documents, but at the end of the day you will have to abide by the decision of your Supervisor or challenge it using formal routes.

What country do your parents come from?
