If I claim back my bank charges and win will the payment go over to my IP for payment into my IVA. As this money is mine and as the bank kicked me over the edge I feel this money is rightly mine.

Please advise.

This is a windfall and thus captured by the term and conditions of the IVA, but in any case I rather suspect that the bank will simply offset your claim against their outstanding claim against you.

Agree with Mel on this. As the bank are unlikely to be recieving the full amount of money they are owed I think it will be likely that they will deduct any refund from the outstanding balances.
