hi, i am on an iva with my husband, £23k is in his name, although his put me on half of the IVA. We are sperating (£3k is in my name)i am on income support, will i need to give all my income support to IVA. I do not work and am claiming lone parent for two children.

Hi Sarah Anne B,

Do you know if it is your Husband's intention to continue with the payments once you're separated? Are you currently contributing anything towards the payments?

If you are going to separate, you must decide with your husband whether you intend to continue to jointly fund the current IVA contributions. If so, then the fact that you have separated makes little difference to the IVA's, although you will need to keep your Supervisor advised of changes of address and contact details. You could pay your share of the contribition directly to the IP, and your husband can do the same.

If, however, your circumstances have changed as a result of the separation, and you find that you cannot continue to make the repayments, then you should discuss this with the IVA Supervisor. It may be that your husband can continue to service his IVA, but a better option for you might be to come to an ongoing payments arrangement for the small amount of debt that you owe outside of IVA proceedings.
