hi all i`ve been in an iva for 5 months now and all is going smoothly except one bank dos`nt seem to accept i`m in an iva i have had loads of letters from them threatening court action and numeruos phone calls i have kept my supervisor informed and he has contacted them and came to the same conclusion as me there highly experienced staff don`t know what an iva is how ever the phone calls have stopped now after the call center admitted they had recieved a fax from my supervisor telling them the information they required but the letters still keep coming and now i`ve had a letter from there solicitors giving me 7 days to contact them and agree a payment plan. oh they also sent me a new debit card a couple of weeks ago talk about lack of communication between depts the account has been closed since september. I had 6 creditors and this one was the only one to have caused me any hassle as i`m protected from them in my agreement can i take action against them for causing undue stress and anxiety,i will be informing my supervisor of this latest development tomorrow i won`t name the bank at this point as there must be ANOTHER WAY to get the message through to them.has any one else had similar problems

I am afraid that you are just another victim of poor administration within the bank's collection departments.

It seems that everything you can do to inform this creditor of the situation has been done, so the next time you get a letter I suggest that you write back and threaten a complaint to the banking ombudsman. This may well have the desired effect.
