Having survived for a number of years on an IVA I managed to resolve my financial difficulties and repaid the IVA in full. The final payment was made in April 2007. I essentially forgot about the thing and got on with my life. In due course my certificate of completion was issued.

I didn't pay much attention to it at the time and simply filed it away for reference. Over 4 years later, I'm now looking to get a mortgage, but I'm being turned down. It transpires that the date on the certificate is October 2008! It took the administrators 18 months to complete the work?

Obviously that's ridiculous, but is there anything I can do about it now?

I forgot to add that even though I repaid every penny owed, Cahoot - and I've been giving them hell for three years - still steadfastly refuse to remove the credit default from my credit history. I'm still in 'default' though everyone else is 'satisfied'. I thought that was the job of the IVA administrator too?

Welcome. I suspect your problems relate to defaults on your credit record with incorrect dates. Once you have your completion cert, just obtain your credit reports from the 3 main companies and sent a copy of your cert to the data controller at any creditor who has a default date after the start date of your IVA. From what you say, it looks as if Cahoot are responsible for your difficulties, not the date of issue of your cert. All defaults should have disappeared 6 years from the start date of your iva

Hi Tangram - welcome to the forum - cleaning up the credit file is our own responsibility Not the IVA company.
Write to the Data controller (NOT CUSTOMER SERVICES) at the company (enclosing a copy of the certificate) asking for the default date to be changed to the start of the IVA. Give them 28 days - If no joy
write to the Data Commissioner (enclosing copies of all email/letter etc.

Use recorded delivery with all mail

That's fabulous advice. Thanks very much for that. I'll get on that tomorrow :o)

Unfortunately, while the cahoot thing is undoubtedly a factor, one of the conditions of the mortgage company in question is a three year gap between the date on the certificate, and now. Because it took Synergi so long to do the deed, I'm still three months away from that point.

The original question still stands, then. Is there anything I can do about the 18 months time difference between the date Synergi was given the final payment and the date of issue of the certificate?

Suspect there is nothing to be done about that now, I know that it does take time to complete all the paperwork and whilst I feel 18 months is a long time think its too late in the day, once its been issued. Have you tried speaking to Synergi about this?

I cannot quite see how Synergi have dated the Completion Certificate so long after the expiry of the IVA. An IVA can only last for the length of time in which it was intended to last, so I would suggest that you contact them and ask them to provide a redated Certificate which you can then produce to prospective lenders if this is necessary. Something does not seem quite right here to be honest.

Thanks Melanie. I'll give them a call tomorrow. I think the guy who was handling the case is still there, so hopefully he'll have some memory of it. Hopefully that will speed up the process of getting a revamped certificate. I need this sorted quickly or I'm going to loose the house :-(
