10% overtime rule

ok, i know everybody has a different overtime clause, but my OHs states, anything over 10% of debtors normal net income is 50/50 split. question: is that 10% over OH salary or of household net income. just wondering on the figures so i know how much to put back for extra payment. if its just his income that 10% is based on, then can they justify taking any of my overtime payments??? not that i do any, just looking at it logically [;)]
