actions of creditor that did'nt vote?

hi this is my first post,could you please help with this question
i have just been accepted for an iva, one of my creditors is for an overdraft, and credit cards with same bank and were on my creditor list but did not vote on my iva, are they stll allowed to take payments out to pay for the same credit cards as they have not frozen my bank account yet

Hi Susey and welcome.

Once your iva has been agreed, all creditors are legally bound by it, whether they have voted or not.

Have you changed your bank account to one who is not a creditor? If not, you may find that they close the account, and you would be advised to find a new one quickly.

You should also have cancelled all direct debits for credit cards etc.

thank you so much for your reply, i have opened a new key account and cancelled direct debts ,but not sure what happens about charges from the 1st of august to the 1st september, over draft charges and returned direct debits that will be charged in october ,these were before my iva was passed on the 8th of september, theses are to be applied on the first of october, and will take me over my overdraft limt again , can they charge me an overdraft fee again , and would this look ike i have taken out more credit

Once your IVA has been agreed, your creditors cannot charge anymore. If you have any letter etc about this, get in touch with your IP and he/she will deal with it.

If you are really worried then get in touch with your IP anyway.

All charges should now be absorbed into your IVA.

All those charges will be included in your IVA.
