Advice for partner of potential IVA person?

Would really value some advice regarding few questions.

1. I own my own house (with mortgage), have own income, not really in debt.If partner goes for IVA will any of my assets or earnings be taken into account?

2.Because partner has big debts (due to unforseen problems) he has not been able to contribute towards his keep for at least 6 months which is now starting to affect me being able to pay bils. Can I be classed as a creditor as Im owned money in back rent?

3. Would/could he be classed as a lodger as we are not married?

4. How would the IVA process look at his need to pay towards living arrangements(all bills are in my name only)? Can he claim an allotted amount?

Any advice on how to go about the IVA without it affecting innocent party would be great.

Hi Dolly and welcome to the forum

1 That will depend if you are living together as a couple, or are simply housemates. If the latter, then your assets and income would not need to be taken into consideration.

2 You can be classed as a creditor if your partner owes you money and you can prove your claim.

3 That would depend on how you categorised your actual partnership - lifepartner or lodger?

4 He would need to demonstrate exactly what he pays for, which ought to be a specific share or set amount you require him to pay.

To answer your last point - could you confirm what your partner has spent the money on that he has borrowed? Himself personally, or on items and general expenditure for your home.
