advice for serious psychiatric problems?

Do you offer advice regarding individuals whose debts have occurred as a direct result of serious psychiatric problems? I am managing my father's debts via Power of Attorney after his psychiatrist deemed him mentally incapable of managing his finances. His debts occurred during a time when he was seriously unwell, in between periods of hospitalisation under section. The total debts amount to approx. £30,000. He has no income other than a state pension and small work pension.

Hi ffi and welcome to the forum

I have dealt with several clients in similar circumstnaces to your father, but given his circumstances I would have thought that bankruptcy proceedings are perhaps a better option. Does he own a property with equity in it?

How were the debts accrued and the type of debts.

If your father has a psychiatric illness and it existed before he took loans,then there may be case to argue that he was not aware of his actions and ask the debts to be written off.

If he was not responsible for his actions because of psychiatric illnes then I would say he is not responsible for payments.

May you may have to seek a Lawyer's opinion.

A few months ago I read somewhere that creditors had to write off in a similar situation.

This may have to be looked in to further before considering Bankruptacy.

How old is your Father,if do not mind?
