My wife and I are separated and she's decided to leave me to pay the IVA. She hasn't given the IVA people a forwarding address. I have since found out that she has ALWAYS had debt throughout our IVA. Am I liable for this debt? and her breaking of the agreement. I have been clean and have no debt and stuck to the agreement throughout. There is 13 months left to run on the IVA.
Hi I would ring your IVA company quickly and explain everything , I honestly don't know where you stand, but you need to be upfront and honest with your company.
Were you in a joint IVA ?
If so they will probably need to know her forwarding address.
I hope someone will be on in the morning to advise you better then me
Are you in interlocking IVA's (an IVA each, but make one joint payment) ? Her not informing them of a change of address is a potential breach. Also, in some interlocking IVA's the failure of one fails the other (it depends upon how yours has been drafted). If so, it might be wise to get them seperated and each of you carry on with your own arrangements individually. As advised above, speak to your IP.
My opinions are merely that .. opinions based on experience. Always seek professional advice.
IVA Completed 23rd July 2013 .... C.C. 10th January 2014
Severing the IVAs is not difficult unless there is a property involved. Your IP should be able to help and keep your IVA going and possibly failing hers.
