My iva was 2 years old on 26 sept 2008 so am into the third year. Have had my annual review with no increase which is good. I am concerned though although i have asked for a copy of my annual report I am told it should be with me in 28 days and Ive asked for it on email as I do not get all my post due to varying postmen but been told on enail it has to be a signed copy so needs to be posted.

I am going to ask for an email unsigned and for it to be posted for this reason.

Also the fact that it is taking so long makes me worry is something wrong? last year I was told off for paying too much money into my iva by about £500. because my wife suffers from depression big time which affects ger arthritis all we need to know is are we on track we dont mind if weve paid too much again as long as weve paid enough which Im sure we will have as shes pedantic about our iva succeeding but Im worried about her worrying.

I understand that the report is in draft. Am I entitled to see it in draft or speak to soemone just so i can reassure my wife whos a bit paranoid at the best of times that all is ok?

any advice appreciated as I know shell be thinking about it all over Xmas and probably worry herself to death until we have received this thing.

We were transferred to DFD which is who we are with and so far have found them to be good eg with our annual review (although we did have to chase it up a few times) but this is worrying us.

what should I do? do I just tell msyelf Ill have to wait the 28 days or do I ask for the person who actually produces the report to give me a call so i can explain? thanks for any advice

The report ought to have been finalised by 26 November, so you are well within your rights to demand a copy to be sent to you now.

thanks very much melanie I have asked for the manager of my case to ring me at home to get it sorted I appreciate their help very much and dont want to upset them but have heard some scary stories on the forum so need this information for peace of mine

can I ask Melanie for her views please - the manager rang me and said they are doing what they can to speed it up assured me there were no arrears but also said I had not overpaid either (I overpaid last year)she also said she did no have sight of the actual report so could not read it to me but would see what she could do to get this info to me as quickly as they can I insisted on having the info now even if it says draft not final etc as I need to show my wife the words that actually say all is proceeding and everything is ok to calm her down she is always like this until she gets things in writing you see making our iva succeed is so important to us when it was approved it was like winning the lottery jobs like yours must be so stressful I appreciate I also told this to the person from dfd who rang me and said i really appreciated their efforts but i was entitled to this info after 26th nov so required it to stop my wife feeling ill

sorry to add to the above what will happen because if the ip was supposed to submit the report to the court by 26 nov and hasnt will this reflect badly on me? worried again

It will not reflect badly on you at all Hymers. Why not ask your IP firm to confirm by which time they would be able to get the report to you.

Have you spoken to your IP since December hymers? I would keep badgering them as they should have sent the report to you by now.

One of our other posters who has been having trouble with their IP mentioned this forum to them and they changed their tune.

Might be worth giving that a try if all else fails.

Find out why they cannot comply with the Insolvency legislation which mandates your IP to submit an Annual Report within 2 months of a year end. Failing receiving an adequate response inform them that you are considering writing to their regulatory body. Let us know how you get on.
