Hello, ive had my iva coming up to 2 years now. And when i took it out one of the accounts was in joint names, at the time no one told me my wife was liable for the arrears. She has now had to take a loan out to clear this account. Does anyone know what cause of action is open to me ie appealing against my iva ?? thanks for your help .

Hi and welcome to the forum.

You should have been advised of the joint liability on the account in question when you were given the initial advice prior to entering into the IVA.

In order to advise you, I would need ask a few questions;

What sort of account was it?

How much did your wife have to borrow and what are the monthly payments to the loan?

Does your wife work or is she a homemaker?

When you say appeal against your IVA what do you mean precisely - do you mean ask for reduced payments so that your wife can make the payments to the loan? Or do you want to make a complaint about the advice you were given?
