If you don't agree with your annual review then you need to speak to your IP in the first instance.

That is a very good question PM5. Especially those who are in their first year most likely would find that the original calculations/budgets were not accurate necessarily.

Hopefully one of the experts would shed some light to this.

Yes - you can apply to Court for a Judge to rule on the expenditure allowances. This rarely happens, but if anyone wanted to try it I gather judges are pretty sympathetic with people's spending allowances. Just be careful that you do not end up with a costs order against you that you would be unable to pay.

Hi not posted in a while but thought i would tell my story. My IP calculated my income wrong and so to fix it she lowered my expenses to fix it so there was spare money to give to the creditors.I have three kids and with christmas coming and also a fridge freezer that turns itself off its going to be a very fun month or two.

Hi Teresa that isn't good and a very good example of why unless you're 100% happy with your chosen IP, we shouldn't move forward and should always take advice from 2-3 different companies minimum.

I think you need to talk to your IP direct and get this sorted out as there are guidelines for income and expenditure.

How long have you been in an IVA? I'm wondering if you've had an annual review as yet?
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

I agree that it doesn't sound good and that you should contact your IP.

I am nearly three years into it. At my last annual review when she calculated my benefits she worked it out wrong and put down that i was getting more than i was. It was only after nearly six months of struggling that i asked her why this was and the discrepancy was found. her sollution was to lower the payment and extend it by six months which i really didnt want to do so she lowered my expenditure to compensate. But as compensation i told her that i wanted to keep all of a bonus from my partners work to pay for all the things that had built up from not having any money at first she agreed but then she changed her mind and wanted half the money. Sorry its very complicated and i hope i am explaining myself right.

Teresa it does sound complicated and maybe you should stand your ground. It may be worth asking for a face to face meeting with your IP and a breakdown of everything that has been paid. You can then seek advice elsewhere to see if you have been treated fairly. If your IP does not agree to a face to face meeting there would be grounds for a complaint. Good luck.
