Hi all,


I said I would try and get online to let you know how my day in court went so here goes.

We dropped our daughter off at school then made a sharp exit to Lincoln County Court(we live near to Grantham) well what a farce trying to get there was! Appointment was at 10am so though we had ample time to get up to Lincoln, however road signs are in short supply in some parts in Lincolnshire - we made it into Court at 9.57am!

A lovely lady was waiting for us and took me and my husband into a small room and went through our papers, she was really nice and put us at our ease. We didn't have to pay the court fee as we took our tax credit awards with us so they waivered it which was good news so we just paid the OR's fee (I think she called it). We then had to pay and go upstairs whilst she went into the Judge to get our forms signed (we didn't have to see him) some woman at the upstairs reception was really snotty with us as she thought we were there for family court then was really nice when we told her we were there for Bankruptcy - strange attitude.

So back down into this room again and there we have it, at 10.31am I was officially made bankrupt and my husband a minute before that.

She said that she would inform the OR not to freeze our Lloyds account as it's a totally basic one with no credit facilities so we can keep it which is good news as I didn't fancy rushing round Lincoln trying to open a bank account. She also said the OR would ring us either this afternoon or tomorrow for a 10-15 minute interview i'm not sure if that will be it or there will be more interviews to follow, not hugely looking forward to that bit though.

All in all it wasn't as bad as people would expect it to be, we weren't made to feel like total scum bags and were treated with respect at what was and is a difficult time in our lives. I'm very glad that bit is over though, I am expecting to be an undischarged bankrupt for longer that 12 months though but I don't care at the moment.


I hope my experiences help someone else in this situation, sometimes this is the only way out for people and it's a big step and will need all the help and advice and the experience of other people they can get.

Glad to hear it went ok for you! We were made bankrupt a couple of weeks ago. Why do you think you will be an undischarged bankrupt longer than 12 months though?

We had our OR interview last Friday and I am now really panicking as we do not have much surplus income but we feel the OR is going to try and slap an IPA on us! We are very worried, we have struggled for so long and now looks like we will continue to!

Thanks for posting and yes your experience will help others.Most people are totally scared of bankruptcy but by posting real life experiences of the process will help to show that bankruptcy,in reality,is not at all bad.

I foolishly omitted some creditors from my IVA, a big nono so I think he will come down heavily on me for that. I was lead to believe that if you had little surplus income the OR wouldn't enforce an IPA. Have I got that wrong too then?

Thanks everyone, The OR rang just as I was picking my daughter up from school. He seemed ok and we went through some details, he's ringing back next wednesday at 9.30 am for the 'proper' interview.

It, interesting that you did not have to go before the judge an this seems to be the norm at the moment.
Maybe in a few years someone can bankrupt themselves totally online by submitting the forms and having the OR meeting via emails.
Infact I,ll put money on it.

katy you will only be BR for 12 months it doesn't last longer than that, can even be less, only the IPA will last longer or if you get a BRo/BRU don't worry.

all going well, fingers crossed she has got this council house close to her mum, she has also gone back to work one day a week, her confidence is growing and she is adamant she is not having him back, the house is now up for sale through an estate agents instructed by the mortgage co, she has got her belongings out and womans aid are looking after her very well, so good results so far, sorry i haven't let everyone know, we are just keeping our fingers crossed on this house, but she said to me she is looking forward to new beginnings and the start of a new life, thanks mel for asking, she has really come out of herself, her mum hopes it will be the making of her now as long as she doesn't go back to him, but she knows she can't as she will lose all the help off womans aid they are paying for the storage and claiming it back off the council she is still in temp accommodation but she is happy!
