Melanie, thankyou for using your time on a sunday to give me advice it is very much apprieciated. If my wifes equity is intact in bankruptcy does that mean my beneficial interest is half of the total 38k equity. If that is the case would 19k be enough for an iva and would my brother in law then have to contact my creditors to arrange this? I am sorry to ask so many questions but i am trying at least to get this part right so that my wifes family dont think i am a complete idiot.

I am sure that £19k would be sufficient to propose an IVA to your creditors, and you would need to find an insolvency practitioner to represent you in this regard. It is the IP's job to then make the representation towards your creditors and not your brother.

And don't worry about bothering me on a Sunday. Good IP's make themselves available for clients at any time, although I am going to take a break shortly to watch Cardiff City (I live in Cardiff!) in the FA cup semi-final!
