any information relating to the rules of bankrupcy

my dad has been made bankrupt at the end of jan 07. 3 members of his family including himself, me (daughter)and my husband all have contracts with vodafone in my dads name.
will any of these contracts be affected by my dad being bankrupt?
i am asking this because talk-talk have canceled his land line phone & broadband today even though he has paid the bill in full when it was due last week, is this also a possability due to bankruptcy?
also can anyone send me a link with any information relating to the rules of bankrupcy reguarding existing contracts, ie..phone bills, car insurance etc...

Hi watweb and welcome to the forum. I am petitioning for BR in April, and I rang Vodafone yesterday as I am unsure whether I will have a bank account in time to pay by DD. I was advised that they won't just cancel my contract, and if I have any problems to call them as they have a specialist BR department who may be able to help me. It might be worth giving them a call.

Noramlly, if you are declared bankrupt you will be able to continue paying a monthly mobile phone contract as long as the monthly payments are reasonable. I have not heard of Vodafone cancelling a contract where someone is made bankrupt. As long as the monthly bils are bing paid, why would they?

The rules as far as bankruptcy is concerned about any existing contracts such as car insurance, mobile phones, car HP etc are that as long as the Trustee in Bankrutpcy is happy with the expenditure, the the supplier is happy (ie the monthly payments continue to be paid) then there should be no problem.

In your case, you say that you Dad has multiple contracts in his name. I assume that given the contracts are still live today, his Trustee in Bankruptcy must be happy that the payments are being covered by the thrid parties (ie you and your husband).

As long as the Trustee is happy and the monthly payments are being paid, I see no reason why Vodafone would cancel anything.

I'm a bit worried about my contract as it's for £35 per month, so I think the OR might say that's a bit high. I have tried to reduce it, but Vodafone won't let me at the moment (Ts & Cs of contract as I upgraded my phone). If I have any problems I'll speak to Vodafone and hope for the best!

No - the OR will not be too interested in your mobile phone. £35 is a modest amount for an asset which is essential for your personal safety.

To the original poster, the following website gives you lots of information about bankruptcy proceedings, but I suggest you ask Vodaphone to transfer the account into your own names - providing you are aged 18 or more.
