hubby got a letter today so thought i would share it they sound like a mortgage co for iva's and BR's too me.

they are based in Essex:

Dear MR X

please excuse this unsolicited letter but we have recently seen from the insolvency services that your are currently BR and we may be able to offer you some assistance if you are a homeowner.

the law governing how properties are dealt with in BR changed with effect from April 2004. the act provides a limit of three years during which time a trustee in BR can deal with a BR's interest in a dwelling house which is the sole principle dwelling house of the BR, the BR's spouse or a former spouse.

your trustee in BR has one of the following options,
apply for an order of sale or possession in respect of your home.
apply for a charging order over your home preventing you from selling it.
enter into an agreement with the BR regarding the interest.

has your trustee approached ou regarding any of the above?
if so then you should be talking to us!

whilst the interest in your property will have to be realised this does not necessarily mean that you will lose your home. there are various ways in which this can be dealt with including remortgage, selling your interest to any joint proprietor or selling your interest to a third party.

we are specialists in this field and can:
arrange mortgages for people with bad credit, including BR's
negotiate with trustees;
reverse people out of BR into an iva.

do they not think we would have tried some of these routes any way before going BR and why would we want to reverse the BR now we are discharged?

They are not on the FSA register and I can not find a website for them, do they have an FSA registration number on the letter?

Ohhh that's very naughty, they are not on the register. The registration number you gave is their company house number not an FSA number - they are not authorised to offer advice or arrange mortgages or insurance. This is VERY annoying...

I absolutely agree Andy - perhaps iva.co.uk would start a petition to have this register removed from general public view and lobby the DBERR. After recent events with the IVA Council, I am sure there would be many supporters, and I would definately put my name to it. Some of the mail I see my clients receiving is entirely inappropriate.

I also agree, I can not for the life of me understand why they need to include so much information. Not that I would expect it to carry much weight but Leybridge would also be willing to put our name to any petition.

Maybe Channel 4 can cover in their program how unregistered companies are using the insolvency register to pray on people at a very vunerable time...and call for the insolvency register to be scrapped??
If they published a list of all old ladies, living alone, over the age of 80..with their addresses there would be all hell on..The Iva register is just as bad!
A credit search reveals you have an IVA, what more is needed!

I too agree this info should not be so readily avaliable. We have had sevral letters over the past 12 months from these kinds of companys and they must get their info from the register.

I agree as well since going into IVA we've received more junk mail (if that is possible) I don't necessary disagree with an insolvency register but perhaps they should just put your name and the town that you were declared insolvent in.

I think most of us have the knowledge to know that this unsolicited mail is rubbish and to stick with what we've got however c**p it gets but I do realise that there are people who will do anything to get themselves out of this situation and in the long term will end up losing out financially because of these rogue companies.

I hate having my name, address, previous address and date of birth available on the register. I appreciate that BR is public (although I don't think that so much information is necessary), but I was told that an IVA wouldn't be public, and I only found out about the register thanks to this forum.

It is possible to set up a petition on the Downing Street website for the attention of the Prime Minister. I haven't got a clue how to do it, but I don't know if anyone else would be able to.

Yesterday is history, tomorrow is a mystery, today is the present - a gift to make the most of.

If we were to start a petition on this issue, what would people like to see covered by it?

For instance, should companies have to reveal their intent for the information and register with the Insolvency Service before they are allowed access?

Should mass mailings be banned?

Let us know your thoughts.

I think at the very least companies should have to register their intention of use and have a valid reason other than marketing to be able to access the nformation

I agree with Mike and would just question why the register is publicly available on the internet now, and that if they are prepared to consider removing it, whether they would question the intent of individuals or companies asking for global information rather than on a case specific basis.

And it might be sensible in the first instance to speak to them about the concerns of your posters - as iva.co.uk is becoming quite a recognised voice in the industry and may carry some weight.
