as a nurse will I lose my job if I become bankrupt

I have heard thta as a nurse if my iva fails and i become bankrupt i would loose my job. Firstly is this true? this hardly seems fair when my financial situation does not affect my ability to do my job, and secondly does it only apply to nhs employees, or does it affect my registartion?

I think rule applies to a few jobs like nurses, police and mine the armed forces,

Hi.You would need to check with the NMC, but I hope you're mistaken because I'm also a nurse and although I'm not intending to fail my IVA I will worry about this too now!!!I think even the police have a welfare system that eals with this kind of stuff now, but I think accountants and solicitors (people who look after potentially huge budgets) are people who wouldn't be able to practice. Hopefully an expert will be along soon.My IVA company know I'm a nurse and did not give me this advise. Cat

I have just checked on NMC website .If bankrupt the creditors have aright to complain to the NMC but this would not automatically result in loss of registration and would rearely mean loss of job.Do you manage a budget? Even if you do, finacial people usually 'oversea' this process.It's very unlikely that there would be opportunity for you to have access to 'real' money anyway.Cat

I would agree with Andy, I have never known a nurse to lose their employment due to bankruptcy.

Hi I am a Nurse and was in an IVA that has recently failed. One of my options is bankruptcy, I contacted the NMC and Unison , neither said Bankruptcy would result in loss of employment, unless debt was through a Fraud.

This is a Fact as I have thoroughly looked into it. Actually NMC and especially, Unison offered support both emotional and financial.

thankyou for all your advice, it has really put my mind at ease. In answer to Andy's question I have recieved this information from my iva agency. The first time was when i was deciding whether to take out an iva, and they said it was a possibility but could not say for sure. I have recently had some changes in my circumstances and may need to make a reduced payment to my iva for one to two months max, and the person i spoke to said it was definite as the nhs had this as a policy! I am not planning to fail my iva, but the big name company i use are very inconsistent with their advice, and i seem like i get a different response everytime i speak to them. i just had my first review and they wanted me to increase my payments, when i checked this out with them they didnt even have the correct amount i was paying down, even though it was part of my ammendments when my iva was agreed. this really annoys me when you consider how much money they take off me.

The reason taht I asked the question is because I did wonder if someone had 'advised' you this in order to stop you declaring bankruptcy and hence their fees being affected.The trouble with large companies is that you often deal only with junior staff who quite simply do not have sufficient knowledge.
Try to deal with them via email or letter as you then have documentation to back up anything that is said or advised.
Bounce as many questions as you want off this forum,you will always receive unbiased advice.

There did used to be a stipulation that Midwifes could not go bankrupt - harkens back to the dark old days pre NHS. As far as I am aware this does not apply now in fact there are only a few jobs/professions that would be affected by bankruptcy.

nicola who are you with. I am positive you will not lose your job as the experts say, it would be very unusal and the HR act is there to protect you. Dont worry I know how difficult and how stressed we can get but your job is safe.
