Not sure if this is the right place for this.

On the 30th September my wife and I had our IVA approved with Grant Thornton as the IP.

Last Friday I received a letter from the solicitors of one of our creditors to appear in court in a few weeks time. I have had no response from Grant Thornton and am now at my wits end.

What if anything can I do?

The creditor voted to accept the IVA and must therefore know it was accepted.

Can they take us to court for a debt covered by an IVA?

Thanks

Andy

Hi and welcome to the forum, they are bound by the terms and conditions of your IVA. On Monday get onto GT again and tell them what is happening they'll be able to help. How long is it since you contacted GT originally?

You are protected from creditors by your IVA. x
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Hi and welcome to the forum.

The debt will be included in the IVA - sometimes it takes a while for the info to filter through to creditors. Send the letter to your IP and they will deal with it.

Hi and welcome to the forum.

Please don't worry - if they are included then they can do nothing to you at all, it sounds like a breakdown in communication somewhere along the way.

Hopefully Karol will pick up on this but if not then contact her via this:

ivacustomerservices@uk.gt.com and ensure that "IVA Forum" is all that is entered in the subject line of the email.

Karol will put your mind at rest.

I know this may be worrying for you but all the other posters above are correct, this will just be laughed out of court if it ever gets there, whether they voted or not, they are bound by your IVA, just forward a copy of the court papers to GT and let them deal with it.

This sort of thing does happen occasionally unfortunately, but as the other posters have mentioned there is nothing for you to worry about and let GT liaise with the creditor directly.

Hope it's all sorted for you soon Andy but as we say it'll be a communication error somewhere along the line. All the best. x

I've changed the title of the topic so hopefully Karol will spot it.
