Backpay and extra payments

Hi

I was underpaid from an employer in May and they said that they would pay me the shortfall in June, of which I explained this to Payplan when I sent my monthly payslips in

However come June pay day, I received a bonus from my full time employment, when I sent my payslips into payplan, I explained how much was backpay from my part time employment which should of been paid in May, (it did state on the payslip that it was backpay) however Payplan are not accepting the fact that it should of been paid in May they have said as it was paid in June its taken into account in June and I need to make an extra payment, I have argued that if it had of been received in May there would be no extra payment to be made as I was under the extra 10% threshold

Are they correct and should I just roll over in defeat or should I keep fighting

You can try to keep fighting but put the money aside in case they do insist on you paying it.

I've been fighting it for 2 weeks now and its making me poorly but they just seem to care, I'd borrowed the money that I was expecting last month so haven't actually got it to pay back so would have to borrow it again ☹

Have you just been dealing with your case manager? Might be an idea to speak directly to your IP either by phone or email.

I did escalate it and they came back and said the same thing, regardless of what month it was for it was received in June and therfore stands

I just don't understand why they are penalising me when it was an employers error, just doesn't seem fair to me

I think you are going to have to accept it - it's a bit like winning the lottery or received an inheritance before you get your completion letter, you would still have to pay your creditors the full amount even though it is unfair.

Yeah, very unfair, won't be doing overtime again to be able to go to a friends wedding that's for sure
