Hi Hillsy
Not sure if this will help you, but do you have an overdraft facility? If not go into the bank and see the personal banker. Stress to them that as you have no o/d facility then they are at fault for allowing the payment and not you. Hopefully they will then refund the £38. this has worked for me on more than one occasion when Barclays messed up. Gotta be worth a try ... innit?? [:D][:D]

After reading the previous posts I started to panic I have only been with the co-op for 4 weeks and on monday my husbands wages are due in (hopefully his co puts it in the right account) I have arranged for dd's to come out the sameday, so I rang the co-op they said with it been wages no dd's will be returned, if it were cash been paid in on monday the dd's would have already been returned unpaid, so i'm not as stressed, changed from the HSBC as they are one of our creditors, since cancelling all dd's with them they have never stopped ringing asking if there was a problem and why have we cancelled all dd's, ehhh! yes I owe you money do they not realise. I must say the co-op are brilliant to deal with can ring local branch and not have to go through call centre.

HSBC were one of my creditors too. Even when I cancelled all DD's, they refused to cancel the one for our loan, so every month they would take the payment out, then put it back and charge me for the privilege!

Didn't matter that I couldn't afford to pay them, and that it put my already overdrawn overdraft even further overdrawn!

Banks are great as long as everything is going along swimmingly, once you have problems, they turn into big nasty sharks!!!!

We are in the same boat with HSBC the loan payment to them still comes out of the account even though it is over the overdraft limit and I keep getting charged, they have tried to take cc payments out of the account but I explained to them that they have to have our permission to do that, and I was not giving them permission so they then put the phone down, I know we owe them, but they don't understand that we are trying to sort it out, we are having to go down the BR route, which was the last resort for us. Not going BR till Sept so I'll have to put up with the calls, or and now e-mails from HSBC.

At least with emails you can hit that delete button, or you could possibly try blocking them.

Phone calls I would either avoid or have some sort of spiel ready and then put the phone down.

Do they know you are going BR? If not, I'd be tempted to tell them.

No they don't know we are going BR, our mortgage is with them they did ask why I changed the DD over to co-op just explained I was entitled to pay my mortgage out of any bank account I wished. Paul Johns from Reviva is helping us he is dealing with them, but they don't seem as though they are listening or reading the letters they receive. This month is they first month we have missed any payments on the cc's, it took HSBC just 3 days to realise then the calls started, havn't had a nasty letter yet i'm waiting!!

No, it doesn't take them long when you default, but when you go br or iva, it seems to take weeks or months before the information arrives with the trained monkey on the call desk!

Must take the scenic route to get there![:)]

I was with lloyds and they took all my wages as soon as it went it to pay my loan without my permission!! I went the ombudsman who then said they have every right to as i owed them the money however they must act responsible about it and leave me with money to live on I.E leave money to pay my rent and domestic bills.... They never did that they took the whole £1500 in one hit.... So the only way i could get my money back was agree they keep £100 of it (fair enough i owed them it and "set up a plan with them") and as soon as it was back in i took it all out!! It was then i seeked help as that was the final straw! Banks are meant to be respnsible lenders but they are not!!!!
Life is one big challenge so what are you going to give me today!?

Never ever have dd's set up for the 1st few days after pay is due in. Get them changed to 3 or 4 days after you get piad so if there are any delays you will have time to notice and inform the bank(they may well offer a temporary od to cover until salary is due).
Also if salary is late in and dd's fail because of this, talk to your payroll dept to discuss them refunding your charges.
Discharged today the 8th feb 2012. View is much brighter now.
Continuing to rebuild our credit worthiness.

For this very reason, I no longer have direct debits, I just pay all the bills when they come at the Post Office! No nasty surprises

Only once have I ever had problems with wages not being paid in on time, and payroll said that they would reimburse any charges anyone incurred.
