Bank Charges

Last week I forgot a DD was due out of my bank account and went £2.70 overdrawn. I paid some money into my account the same day, and Lloyds TSB have said that they 'probably won't' charge me, although I won't know until it actually happens!

Today, I received another letter from Lloyds, advising me that Vodafone had tried to take my DD on Friday, it bounced and they are going to charge me £35. I phoned Lloyds, and they said that they haven't got the authority to reverse the charge, and I can put it in writing if I want as they won't actually take the money until April. It really annoyed me that they wouldn't honour the DD for £35, but they will take their payment for £35! I also spoke to Vodafone, and they were very apologetic as they had moved the DD to 3 days before I get paid. They have agreed to pay the bank charges and move my DD to the 30th of the month in future but that's not the point.

My point is, I am most likely going to petition for bankruptcy in April, so the account could possibly be frozen as they can't tell me when in April they will take it. I presume if I leave £35 in the account the OR will take it? Will Lloyds come after me for £35, therefore meaning I have a new creditor?

If I wasn't planning on bankruptcy I would move my money from Lloyds to Nationwide anyway, but it's not worth the hassle as I'll have to change again. If a miracle happens with my IVA and I can continue I'll definitely change.

This relatively small amount is immaterial in the great big scheme of things so I would happily ignore it. If there is an additional claim in your bankruptcy for £35 so be it. The Official Receiver will deal with it. Lloyds cannot come after to you once a bankruptcy order has been made.

Thanks Melanie. That's 2 weeks running I've woken up to letters from Lloyds! I sat on the bed and bawled my eyes out - as soon as I make a decision something seems to go wrong! At least I know I can get good advice and suuport here.
