Hi All,
Can I open a new basic bank account and set up direct debits before I go bankrupt. And if I do, will I need to include it on the petition form. My petition is on the 24 Oct. But think I need to do this before the 24th as my wages will need to be paid to me on the 30th.

I am not sure if this would be allowed or not. Can anyone put me in the picture please.

Hi UPINSMOKE

When i bent BR I opened a basic aacount with Barclays as they were not one of my creditors, i informed them of my pending BR and asked would they keep my account open they said it would not be a problem as it was only a basic account, you will need to inform the OR of all open bank accounts the OR does not freeze the account this is down to the bank so it is important to check with the first.

Hope this helps a little

CAB have said that even if I open a bank account before BR it will be frozen, don't know what to do now. Any sugestions welcome please. Have been in touch with the bank, but they told me to ring CAB for advice.

Where do I go from here.

up in smoke
It will be frozen - but usually only briefly, its a good idea to have some cash in your pocket when you go BR .
My COOP account was frozen for one day !
If the OR has no interest in your account he will tell the bank and the bank then unfreeze it .. if the OR is interested in the account then you can generally kiss it goodbye.
Make sure that you tell the banks to close your account or the cheeky devils will try to add interest & charges on ! Which the OR then has to deal with .

I have just gone BR and informed the OR of the basic account I have with RBS. She has written to them informing them of my bankruptcy, also told me that they were likely to freeze the account, but because I have debit orders going out of the account she has asked them to allow these. She fortunately has no interest in my account as there just isn't any money in it to be interested in!!!

I have opened an account with ThinkBanking, and I will be paying may salary into that from the end of this month as it offers a debit card with no facilities which suits me down to the ground.

Sue - you do know that RBS will close it once their BR team are advised !
They closed mine as they wont touch undischarged BR's - I have had an account with them since I was 12 - 1965 !

Hi, UpinSmoke, as long as the bank you open an account with isn't a creditor, or the account isn't overdrawn on the day of your BR, then there shouldn't be a problem keeping the account. Yes, it will be frozen for a short time but if you leave just enough money in there to cover your direct debits then the OR will ask the bank (providing the bank allows undischarged bankrupts to have accounts) to allow your direct debit payments. I opened an account with ThinkBanking and so far so good! It wasn't all set up in time so I missed a couple of DD payments (water, house insurance etc) but all I did was phone them and they agreed to take 2 payments the following month. Is your current bank one of your creditors? If so, you have to ensure that your pay doesn't go into it because you'll never see it again!!!

Hi Sue i am with thinkbanking also. I would change all your debits to their account to be on the safe side. I had loads and it didnt take very long.
