I had a bankruptcy order in August 2006; my question is this....i) the receiver is asking for three missing bank statements from two years ago. I don't have them and therfore cannot explain two cash receipts into my account. Is this likely to gain me a BRU/O. ii) Secondly, I gambled heavily online for a period of a month (about 13 months before declariong bankrupt), turning a credit on my bank account of £13500 to a debit of £7500. Again, assuming he takes the view I worsened by position by £20500 a year before my bankruptcy (although the increase in debt was £7500) am I like to get a BRU/O

Regarding point 2, it would probably depend on what point you were or should of known you were insolvent. If you took these actions when you knew or should of known you were insolvent, then it will probably result in a bru/o. But heh ho, as long as you havent committed fraud it would probably be for no longer than 3-6 years depending on exact circumstances. I dont know about point 1 really - but if the cash receipts are large enough to have been important then again it may result in a bru/o if you were insolvent at the time of receipt. But I should say this is just my understanding, Im no expert...

I'm not sure about the BRU/O, as I am sweating on one of those myself! Regarding the missing bank statements, as far as I am aware the OR has the authority to contact the bank and get copies of any statement or credit card that they need.

Yesterday is history, tomorrow is a mystery, today is the present - a gift to make the most of.

I think at the end of the day, even if you got a bru/o it will probably last less than a IVA term so cant be the end of the world. All you can do is be as upfront and honest as you can with the OR and explain things to the best of your knowledge. If you went through IVA, DMP etc first surely this can only count in your favour- you offered better than bankruptcy but the creditors refused or made life to difficult for you.

There is a site that lists recent BRU/O's (cant remember where at this moment) - read the accounts on there and you will probably get some idea whether they are likely to apply to you.

I'll keep my fingers crossed for you both...
best of luck,
Ivoriva.

welcome rcg, skippy is correct. The OR is able to obtain these statements. As for the Bro/Bru don't worry too much about it. There is a site which list the offences which people have been BRO/BRU for. Click the link and read. Ask yourself,'' Gee,did I do any of those things?''

The link is:http://www.insolvency.gov.uk/. Once there read the left hand side list ' Bankruptcy Restriction Search', and click.

Don't fret. You have been through enough.

Take care.
