i have asked this question on the BR site, but would like to know would the OR let you miss a few mortgage payments to raise the deposit for a place to rent and for the first months rent, if so what impact would that have on my mortgage provider could they ask me to leave straight away and start repossession.thanks

Hi kerri

The Official Receiver has no control over your mortgage payments - this is a secured debt, which gives the lender proprietory rights over the asset in the event you default. Under the Law of Property Act 1925, a lender can take possession action against a property when three outstanding intalments are unpaid - as you are thinking of giving up the property and moving out, this should be of little concern.

Possession action can take up to 6 months or more to progress, so this gives you sufficient leeway. Tell the Official Receiver what you are doing, as they may ask you to pay over the monies to them but I feel this is unlikely.
