am in a situation involving the termination of my IVA mainly due to the IP not keeping our account upto date.... and after fours yrs were been alocated a new relationship manager who is stating we havent sent paperwork in from 4yrs ago and theres stuff missing of file, they are now pushing for termination in the next 29days any info on bnkruptcy would be much appreciated as our house is jst above negitive equity(about £2000). were not bothered about having to move and having to rent we just want our debts gone now.. i need to know what docs i have to produce cost etc of bankruptcy will i still have to make monthly payments to my creditors after declaring bankrupt? :-( they think they have won but im going to come out on top.. x

Hi Rachel,

Which IP Company are you with if you do not mind me asking?? Have you spoken to your IP direct regarding this issue as having paid 4 years contributions there is no way in hell I would let them fail my IVA now due to a fault on there part - how can they chase you for paperwork from that long ago!!! There issue not yours.

I agree with Rayb Rachel,

It seems a bit harsh after 4 years of paying into an IVA. If you have no disposable income anymore could they not propose offering funds received to date as a full and final settlement by way of a variation? I'd suggest having a chat with someone at the company you are dealing with.

we have a new money manager and to be honest he is a bit pig headed which fair enough you probably have to be in his job.i have agreed to up our payments by £94 a month which will be a struggle but even that does not feel good enough for them even though it as him that suggested we increase by that much.i have had a good think over the day and i will fight them tooth and nail over ths..i was told to pay a set amount each month whilst on mat leave and because my old money man did not write this on my file they now say it is our fault.

I would certainly stand firm if you can't afford this.

Try contacting the IP direct rather than speaking to one of the office staff.

I would get your IP to put in writing to you all of the issues they claim are causing your IVA to fail from their perspective, and you can then address them one by one. There must be a compromise to find in all of this which helps you to avoid bankruptcy proceedings.

I didn't realise that was the rule. There are several other posters who have their websites and company name in their posts... Is this because they are forum experts?

This is the rule. You have to be an expert to be able to post limited links in your signature, and email details are not allowed at all.

No worries.

If you wish to apply to become an expert then send Andy Davie an email asking if you can be made an expert.

You will then be allowed limited advertising but no email addresses.

seriously eight payments left till 5yrs is up.. were with freeman jones.. they wont accept any liability for the mess were in saying we havent got anything in writing - its our words against theirs.. some of the paperwork there wanting is rediculous, we just cant find it or get a copy, so its a breach of contract.. surely in the last eight months they should be just willing to accept payments and the 6month review etc is just a formality.. depresion kicking in now :-(

also forgot to mention that according to our new relationship manager we have paid approx £13,500 - only £5000 to my creditors... :-( seems a bit steep on there fees...

have to sort it within 30 days - 2of which have gone 28 to go....

agreed their issue not ours but they dont seem to care they just want there paperwork, surely if this paperwork was that important they wouldnt have accepted the last 4yrs worth of payments ? seems like they were happy when they were getting there money!! these issues only arose when we started paying reduced fees (as advised by the relation ship manager we had for 4yrs)
