My wife has today had a test from Barclaycard advising that if we do not contact them they will apply for a charging order on our home. Is this usual method for advising a customer that they intend to apply for a C/O or are they simply trying to scare her.
We are about to apply for an IVA but things have taken along time to progress.

I am not sure what you mean by a test, but Barclaycard may be well within their rights to apply for a charging order if they already have the benefit of a judgement against you. This is just another method of debt collection, albeit a nasty one - and you must inform your IP of this immediately and ask them to get their skates on.

Don,t worry about it - I had the same day after day several times a day sometimes right up until the creditors meeting; they will also tell you they do not accept IVAs yet they voted for mine. The people in the call centres have no say - when they threatened me with that I asked a solicitor how long it would take to get one - several weeks he said - they would need to get a CCJ first. Hope this is of some use to you.

Thanks elv5 and Melanie. They have not yet sent any CCJ details but I was concerned as to the general process. I was pretty sure from the postings on here that they first needed to secure a judgement, but a little knowledge from others sets my mind at rest for the remainder of the evening.

It sounds like the usual methods of business for Barclaycard. Threatening letters and calls. They really try it on. Them and MBNA were my worst creditors. Kept on phoning all day from 0800 until 2100 at night. However my debt was not passed onto debt collectors, as my IVA just kicked in before that. Looking at past posts, they seem to pass on the account at around the 4 month mark.
However, my IVA was approved 11/5, but i still recieved calls from them up and until end of May. After finally really being obnoxious to them, i think they understand that i am now in an IVA as i have not had any calls in over a week.
