Hi, I just wanted to let you know how I have got on since first joining this forum in 2007.
I have been in debt management with Payplan since January 2007. Never missed a payment and have constantly increased it whenever possible.
In spite of that I was never left alone. I have been constantly hounded. Taken to court. The judge didn't care what I said about my circumstances and how hard I was trying. I had reduced the time from 33 years for repayment to 19 years and would have continued.
The judge doubled the payment as they said it was over too long a period and the debt collectors also were granted a charging order on my property.
A family member paid this for me but then another one comes along.
I have now sold my home and am going into rented accomodation.
Because I receive benefits I cannot get an IVA, yet these companies are still happy to take my benefits as payment.
I would like those that can help change things on this forum to speak up for those of us that are receiving benefits yet can still pay a fair amount, as I was.
I intend to go in hard with F & F's as I am extremely fed up that I feel I have lost a lifetime of work in my home, while others can pay 20% or less in an IVA.
I proposed an IVA just yesterday where the income was made up solely of benefits so it isn't impossible, although a lot does depend on what type of benefits you receive amongst several other factors.

Hmm. What kind of benefits are you receiving? I wouldn't have thought that it would stop you from proposing an IVA, although depending on your creditors' individual policies you may have been advised that they wouldn't accept on this basis.
As size5 says, there are many IVAs approved where the income relies on benefits of some kind. If you haven't done already you should at least discuss your situation in detail with an IP. You will probably need to provide details of the house sale, as if you decide to propose an IVA or go bankrupt this will need to be disclosed to your creditors.
Having lost so much already would bankruptcy not be the best option as many benefits are ignored in bankruptcy and you would not have an IPO/IPA. Given your efforts to repay and the attitude of creditors you cannot be blamed for seeking the best option for yourself.
Why can't you get an IVA simply because your income is from benefits? There is nothing to stop this going forward, and we have got a similar case accepted by creditors this week in our office - clearly for the right reasons and with the client's full commitment to repay his creditors.
If your DMP company is telling you this cannot happen, I suggest you look elsewhere.
When I came on here before I was clearly told that I wouldn't get an IVA because I got benefits. I wasn't suitable because I got Occ Pension, DLA, Incapacity Benefit that will change to OAP in January.
I will be keeping as much money as I can out of the proceeds of my sale and paying creditors as less as possible.
They have treated me abominably. They have hounded me and made my life a misery in spite of paying what was agreed.
I Know I had the money but so has everyone that has an IVA.
I also asked payplan and they said no because they can't take benefits into account.
If I had gone bankrupt I would have lost the lot as they'd want to pay the full amount.
I got in this state because of serious illness and disability, not because of irresponsible behaviour.
Well the place is sold now and contracts have been exchanged and my life's work will be gone.
I now have to move into a rented place where you are not even allowed to have a screw put in the wall. I suppose that's the price I am expected to pay.
Before anyone says it, yes I do feel sorry for myself.I feel absolutely gutted.
If these creditors had given me a chance I would have paid them all with the help of my sister who I would have left my house to. They wouldn't listen. Said they couldn't wait a year.
I had paid over half my debts in one and a half years. I feel I owe them nothing.

ladyc if you feel that strongly and your ip wont make you bankrupt,i am going to be generous here to your creditors,and advise you to make a full and final offer,through your ip with a ball park figure of 99 pence.good luck and let us know how you get on,ps use a 2nd class stamp.

Not sure that trying a F&F of 99p is good advice on a forum that gives advice.
Talk to a few other companies and see what advice you can get. Mine would be save up the money to go BR as soon as you can,theres nothing at all stopping you.

Ronald - LadyC tells us she is in a DMP and not an IVA- therefore there is no IP to deal with.
LadyC - there is no reason why you cannot propose an IVA using the sale proceeds from your property if these are insufficient to clear your debts in full. If Payplan won't do this for you I suggest you look elsewhere.
Thanks Melanie. The proceeds would cover my debts but, after struggling for a long time, I feel I would like to give the money back to my sister now as I have no property to leave her.
I would then buy some necessary furniture as most of mine was built in, wardrobes, cooker, fridge/freezer, washer dryer etc.
After that they will get a share and I hope I can keep enough for a nice little holiday.
If they would have co operated a little then they would have been paid, instead they chose to make my life hell when I was paying them a good amount. In the end this was about half of their normal payment, so I think they weren't doing so bad. Plus as soon as my sister could give me a lump sum they got extra.
I don't understand any of this.
I don't know why the judge took the stance he did either.
If all of the companies took court action and doubled my payment they would have enforced the charging order because I couldn't pay.
I now have another company making a nuisance plus barclaycard, of which I have paid, are still harassing me.It was so bad that I have had to make a formal complaint about them and am waiting to hear.
There is no security at all in a DMP. It was fine for about 9 months then they started pestering.
All I hope is that I can get a bit of peace in my life now and put all of this behind me.
One good thing though, the letting agency said my credit rating was good. I think it must have been a mistake but I'm not arguing.
No I'm not and when I've bought what I need and paid back my sister they'll get offered what's left.
What more can they do. I won't have a property, I won't have any spare money when I've paid astronomical rent so what I offer will be it.
Am i right in thinking it was your sister that paid off one of your creditors for you and you want to pay her back what she paid??? If that was a loan then your sister is a creditor the same as the rest and your other creditors would take a dim view on her being prefered over them.
