am being taken to court for a secured loan of 3,500 for repossion of thehouse even though i have made regular payments for the last 7 months how would the courts favour this

Hiya Stuart and welcome.
Can I ask if you have any formal payment plan in place or a DMP? How much are your arrears and when is your court date?

HI Stuart

From my experience the court will do all it can to keep you in your house and if you have paid the last 7 months, I think you are on pretty safe ground. When you get to the county court there should be a duty solicitor there and he/she will be able to put your case forward to the judge if you wish at no charge. Its a shame its got to get to the court stage though as the loan company will add charges - Have you tried to negotiate with them to ask them to adjourn the date on condition ??? If not then I suggest you do or go to the CAB who will help.

Hi Stuart.

Was this a secured loan that you arranged or is it a creditor that got grumpy and went through the CCJ route then got their loan secured on the house?

Also if you can advise what figure you are paying per month with a little more background then We can give you the right advice to protect the house at court.

I cannot see a possession order being made for such a small amount, but you will have to convince the Judge that you can keep up the repayments to this creditors at an agreed level.
