Bit of advice needed

My partner had an IVA that was completed over a year ago, and was notified by Debt Free Direct at the time of such. He came home from work this evening and opened a letter addressed to him from a solicitors asking him to contact them re a business matter.
When he telephoned them they stated they where acting on behalf of creditors and he owed an amount over £900 as his IVA had failed!
He proceeded to contact DFD as he wanted confirmation off them re the completed IVA to be told that his IVA had failed.
My point is at no time during the IVA or infact in the last twelve months have DFD communicated with him to notify him of this. Why would they inform it was completed and then out of the blue state it had failed.
Can they do this, that's my question. They are now apparently sending him a letter in the post with a breakdown of what he owes.
I'm confused and concerned too!

Hi,

This sounds really strange! Did he have a completion letter from DFD and is he still on the Insolvency Register?

Did he actually get a certificate of completion and final report, or was he just told he had made the final payment ? Tell DFD that you want a full written explanation of the events leading up to this apparent failure.

Yes he received confirmation from DFD re completion of the IVA but we tried to find the letter today and can't locate it, hence why he rang them hoping to get confirmation to forward to the solicitors, to be told his IVA had failed. But to reiterate, at no point during the last twelve months have they communicated with him to inform him of this. As far as we where led to believe it was completed and he could get on with his life.
With regards to the insolvency register, I'm not sure, sorry not very au fait with legal matters .

You certainly have a complaint to make - no contact over the last 12 months and then this is seriously wrong. Keep searching for the letter to confirm completion ...am sure you will have it somewhere safe

Put in his name and it will show up whether or not he is still on the register.

Hi kallis3, I've just checked and his name is still listed. Excuse my ignorance but what does that mean?

Does it say the IVA is still active ? If so the situation might be salvageable.

I've just checked and yes it says its still active.
Just what we need, but I still can't understand the lack of communication for the last twelve months.

It could be that whoever you spoke to at DFD doesn't know what they are talking about. In any event, the IVA has not been terminated or failed. So you need to find out from DFD -- speak to the IP or ask for Laura Harrop -- exactly what has happened and why.

You need to speak asap with DFD and insist on talking to the IP directly.

Hi Foggy, thank you for your advice, I will let my partner know, he is up in the loft as we speak searching for his certificate of completion.
No doubt I will return to ask for further advice.

Just to let everyone know, we have found the letter with the certificate of completion. First thing in the morning will be a phone call to DFD asking what the hell has happened.
