Morning,

I'm 10 months into my IVA and still being chased by HBOS collection agency Blair Oliver and Scott. My IP has contacted them 9 times and sent papers 4 times. But, it now seems that they won't stop chasing until the IVA is registerd at TIX. It's a bit worrying that it taken so long to find this out and now I wonder what will happen.Can the TIX guys actually do anything at this point?

Also, sorry guys, I have a 40% minimum payback clause in my IVA and as only 4 creditors from 11 voted wonder if any of the claim have yet been proved. Hope I'm not in for a shock in years to come. The first dividend is due at the 2 year anniversary (10%). At that point will all the claim need to be proved? and will they all get another chance at the final dividend point to claim again?

It looks like an open cheque to me. Or am I missing something.

DOTS keep thinking it can't get worse for you and then it does. Feel for you mate.

Hi acsn -

I have a Minimum Dividend clause similar to yours and also have a number of creditors who have not yet submitted claims. What I have done is calculate the average increase between the amounts put forward with my proposal and the amounts subsequently claimed by each of those creditors who HAVE so far claimed. As most of these increases have been much the same (percentage of debt wise) it is then possible to work out very roughly how much extra you are likely to have to pay in by working out the likely increase in the non-claiming creditors balances and adding everything together. I am assuming - of course - that those who have NOT claimed will not put forward unusually high claims which would of course mess up my calculations!!! I was thinking of contacting my IP to ask if there are any reasons why creditors who submit late claims might put in unexpectedly high figures but decided I will just wait and see!!!
