Hi

I am filling out the BR forms and on the income part do I need to list the follow:

Wife's maternity pay? (this is only going to be paid for another 4 months and she is not returning to work)
Child tax credits? This is being paid jointly to my wife and me.
And child benefits? This is only being paid to my wife.

Also I moved to Lancs only 4-5 months ago but lived in south london before. Which court do I need to go to to petition for br, can I go to one in lancs or does it have to be one in the area I used to live in?

hello zac, yes you do need to list this income. Although, the child benefit and the maternity pay will not be used in an IPA if you should have one. There is something an OR can do with the Tax Credits but, it's complicated.Look on the insolvency site for further publications regarding bankruptcy and Tax Credits.

As for which courthouse to use. Use the one nearest you. Also, contact the courthouse and see if you need an appointment to petition. Some courthouses require an appointment (mine did) others do not. Another word of advice. If any of the debts are jointly held, your wife will have to file for bankruptcy or the creditors will come after her for payment.

Cheers for that DD, will add them in. I have tried looking for the stuff about tax credits but could not find it, anyone know where it is on the insolvency site?

Hi Zac

You do not use the nearest Court, but the one in the area in which you have lived for the majority of the last six months. In your case it is the one in Lancashire.

Thanks for your help. One other question about the forms. When they ask about your debt they also ask what it was spent on. What should I put down if I dont remember? It has all built up over 8 years. I remember using one credit card to buy a washing machine and other kitchen bits then took out a loan to consolidate all cards then ending up spending on the credit cards again to do house up and what not but done remember exactly.

Hello Zac,

I would advise that the more information you can put on the forms the better as the OR (obviously) has no prior knowledge as to why you are in debt.

A sufficient amount would be A4 size paper, one sided, handwritten.
Although on the actual form you would not be able to fit this in Section 11 but I believe extra space has been allowed in Section 13.

Out of the many cases I have seen the reasons have usually been an accumulation of major events like:
- Loss of job
- Death in family
- Birth of children
- Accidents

If you have experienced any of the above it should be mentioned as this could be seen to have contributed to why you’re in debt.
Also things you spent the money on could be anything like holidays, cars, general living expenditure etc

Thanks IVA experts. Is this the same for section 4 of the forms when you list the unsecured creditors and then on the last cell it asks "what was the debt for?" Its mostly this that I dont recall what I spent the money on? Some of it I do.

Not a problem Zac,

In Section 4 you need to state what you actually spent the money on. Whereas in section 11 you have to explain the specific reasons as to why you spent the money on what you did.

For example:

Section 4: Food, bills, clothes.
Section 11 reasons could be you lost your job and that you were living off credit until you found another job etc.
