Hi all, many thanks for all your best wishes. Well the deed is done! Filed for BR at 9.00am today. The walk to the court was the longest of my life! Almost worked myself up to a panic attack, had to use the loo several times whilst waiting to be seen (i'm sure the clock was going backwards!), and could feel myself about to burst into tears at any moment. But the lady behind the counter was so loverly! There was no tut-tutting or sharp intakes of breath when she read through my forms. In fact if she'd have been any nicer I would have blubbed my heart out!!!! More than can be said of the security guards though, do they go to a special school for abruptness???!! But i'm a bit in limbo at the moment. She went through my forms, corrected a few things, I swore my oath, then paid my money, she told me that my petition would be presented to the judge at 10.00am and she said that someone would contact me sometime today (have checked my phone is working about 37 times!) and I could expect a telephone interview with the OR in about a weeks time!!!! Aarrrggghhh! What now? I asked about bank accounts and whether I could go and open another (my HR department aren't the sharpest tools in the box and am due to get paid in 2 weeks time so need to give them plenty of time to sort out my new account information), but the lady didn't know whether I could do that or not. So, after being in there for approximately 30 minutes (25 minutes of that was waiting!) I walked out of court and came home! I don't know what's happening to my house, my car, my bank account or anything. It was all a bit of an anticlimax, but what did I expect - a crash of thunder and a bolt of lightening???!!!! So now just sat here twiddling my thumbs (haven't got any nails left to bite), I took a whole day off work and am just waiting for the damn phone to ring, I could clean my house but am afraid that the phone will ring and I'll be hoovering and won't hear it and am sooo tired I could fall asleep standing up but again daren't have a snooze!!!! Ho hummm ..... [:(]

Oh and a quick message for Melanie, the clerk at the court knew you, but she hadn't seen you for a while! And she said what a nice lady you were and I'm sure all on the forum would agree!

Hi Brassic, it is a bit of an anti climax isn't it?!? You get yourself so psyched up and stressed out, and it's over with so quickly. I don't know which court you went to, but the security guards obviously went to the same training school as the ones where I went!

Did you actually get your BR order? I had to see the judge and then wait for mine to be typed up. I was contacted by the OR's examiner the next day to give me the date and time for the interview, which was nearly a fortnight later - that gave me plenty of time to worry, although it wasn't as bad as I thought! When she phoned me I asked about my car, and she asked me why I thought I should keep it and then told me she would get back to me after the weekend. I had to phone her back that afternoon with some bank details and she told me there and then that I could keep the car - she must have thought I was mad when I said 'What, the one I've got? I can keep it?'

You can open a new basic bank account straight away, you don't have to wait for permission from the OR. I would advise opening the account in branch rather than trying online.

Good luck with the waiting - that's one thing I'm no good at!

Thanks Ang and Skippy. And to answer your question about whether or not I got my BR order I guess the answer is don't know!!!!!! The clerk said that the petition would go before the judge at 10.00am, I asked if I should wait and she said no! And I don't think I could wait 2 weeks for the OR interview as you did!!! If I had to wait that long the interview would have to take place in an asylum cos that's where I'd end up, wearing a back to front jacket, dribbling and howling at the moon!!! Watching Judge Judy now to cheer myself up (makes me feel "normal" compared to some of the freaks on there)!!!!!!

Right, am trying to do something positive and am looking at bank accounts! I'm looking at opening an account with Natwest because they offer a Maestro card but they are part of the Royal Bank of Scotland group. Now I had a Tesco Credit Card which is also the Royal Bank of Scotland! So does this mean that I can't open an account with them? Will any money paid into this account be seized??

Natwest won't allow you to open an account as an undischarged bankrupt, and I have heard on the forum that they are also closing the accounts of people in IVAs.

The only banks that will accept 'the likes of us[:D]' are:

Nationwide - no debit card, internet banking
Co-op - Visa Electron card, internet banking
Abbey - not sure
Barclays - no debit card, no internet banking

There is also Think Banking, who a lot of people on the forum recommend. I personally aren't keen as they charge £12.50 a month and there is a £25 start up fee.

I would try one of the others first - you can apply for a Co-op account on the phone and the staff are lovely!

I have also got a pre-paid Virgin Mastercard in case my Electron card is refused somewhere. That costs £9.95, is valid for 2 years and there is a fee of 2.95% per transaction so it's ok if you are a light user.

If that was the court I'm sure they will ring back - you'll be fine.

Thanks Skippy. Unfortunately couldn't open an account with the Co-op as they are one of my creditors (or should that be were - past tense!)[:D] but I spoke to a lovely Aussie called Jeremy at Think Banking and have opened a bank account with them.

Glad you're sorted and that you spoke to someone nice there - the guy I spoke to kept trying to push an IVA on me, despite the fact I'd just told him I was BR!

Good news and bad news!!! Good news - I'm bankrupt!!!!! Bad news - my OR interview isn't until 12th September! So that's 14 days in agony spent waiting to find out what's going to happen to my house and car, and 14 days agony over whether I've included everything in my I&E!!!! If I have missed anything off my list - should I contact them now or wait until I actually get to speak to the OR?

Also have another problem!!!! Because my mortgage payment was due tomorrow I phoned them Monday and paid on my debit card (while I still had one!), I left it till Monday because I expected my mortgage payment to come out on Friday - just my luck it was later this month! I left this money in the account and withdrew all the rest yesterday. Only problem is my bank statement isn't showing the amount as having been paid, think it's in cyber space somewhere! It hasn't yet been paid to the mortgage company but it's not available to withdraw!!! I spoke to the bank and they said that the payment hasn't been requested yet (?) so I phoned my mortgage company who just said that it's been credited but they haven't actually had the money yet and it sometimes takes a few days but it "should" come out today! I did explain that it was somewhat urgent that it definately come out today but she wasn't interested!!![:(!]Someone from the court telephoned me regarding my OR interview date and I explained the situation, but she said as of tomorrow my account will be frozen and advised just to withdraw the money, but I can't! So looks like I can bend over and kiss £554 that's in the account (that was meant to be used for this months mortgage) goodbye and then I can look forward to getting a demand for this months payment from my mortgage company (probably with an added extra for the request being denied!), money I haven't got as have just paid £485 filing for BR!!!) So much for the start of my debt free life!!!! [:(] Sorry for so many postings and my ramblings today, just thought that I'd have a clearer picture today and feel relieved but I'm as stressed as ever!!

Glad you have got that all sorted. Which Court were you in - Cardiff? Read Pippa's post over the last few days - same Court, same OR probably - so this may give you some form of indication as to what may happen re the property and the car.

Hi
The £544 sounds like it has left your account and will be paid to the mortgage company.Once you make a debit card payment it is deducted from the available balance but still shows on your overall balance for two/three days.
Don,t worry because it will be paid.
