hi hope all ok i just wanted to ask this question to clear up a worry really.my iva was passed at the end of april and i had my chiarmans report through.i had 4 things owing to the halifax.2 credit cards,a bank account charge of £35 and a loan for around £10,000.there was a selection of others too but its the halifax thats bothering me.on the chairmans report the 2 credit cards and the £35 were on the list but not the £10,000 loan.when i phoned up my iva company at the end of april they said not to worry as it was on the original proposal.the thing that is worrying me now is that the only creditor that is chasing me now is that halifax loan saying they have had no details of the iva being passed.
when i phoned my iva company last week just to put my mind at rest after another letter from the halifax they said that they would check it out and came back to me and said that each of the debts had a reference number and that the loan had been put through on the reference number of the £35 bank charge by mistake.i got a bit confused at that point (dosent take much normally anyway!!)however they said again not to worry as it was on the original proposal and so would be bound by the iva.
sorry for going on and on and on i just wanted to make sure this was right.think im just a bit worried that its got left out somehow.they are still adding interest and charges to this loan account

It sounds as if an error was made on the Chairman's Report, which your IP ought to correct and re-circulate to the creditors by way of clarity for you.

would you say without them doing this i am covered or not with the halifax loan as i dont think there would be much chance of talking them in to doing this? the halifax requested me to sort a fax from my iva company of the chairmans report but they have still not done this and that was 2 weeks ago.i think the advice you gave me on another topic about e-mailing my ip directly was good advice and thats what ill do now.after 7 months of starting proceedings for my iva i just want all the worries to stop and to buckle down to get these 5 years over as painlessly as possible.thanks for your help wish id known you existed in january and thanks to everyone for support i hope ill be able to do the same for someone else in my situation in the near future.xx

You will need to check with your IP exactly what the error was, but I would say that the Halifax loan is correctly recorded.

My chairmans report only stated the creditors which had voted but like yours the others where on the original proposal. I found the companies that i had credit cards with voted yes but the others that were loans didnt vote even though they were the same company as the credit cards. Dont know if this helps.

my iva has been going for just over 3 years now and i still get some of the creditors contacting me.I WOULDNT WORRY TO MUCH as long as they are stated in your report it will be fine .i used to get really stressed when they kept contacting me.But my supervisor says they are included in the iva so they cannot do anything even if they keep threatening like some have me.

I am really surprised that you are still getting calls after three years! I am afraid that I would be quite abusive on the phone to them.

I was told that it is illegal for them to contact you and/or demand money once the IVA is in place, and I only had one.

As a bit of a drastic measure, could you not get your phone number changed? At least it would put a stop to it.

I'd ask my IP to have a word with them as well.
