Can anyone shed light on whether PPI money is mine or not ?

Hi my I made my final payment to my iva in June 2011 I was sent a letter saying it had been extended for 6 months due to me owing 217 pounds which I Paid instantly in June over the phone a mark dunleavy then told me my completion certificate will be with me within 3 months it's been nearly 6 now as the extension was until 30/12/11 however last month I received a cheque in my name from egg saying 1700 had been paid into my loan and 1700 to me from ppi, I told Harrington brooks and they said they would get back to me as to whether it's mine or not? Surely my certificate is done now along with any paperwork etc as I made my final Payment in June? Can anyone shed some light hear? I'm sick of wasting money calling Harrington brooks to be passed from pillar to post with one saying its urs and the other saying I don't kno!!!

normally until you have the certificate - the IVA is still active - i assume the PPI claim was made a few weeks ago? - windfall usually go into the IVA pot once they are known about (not just when you receive the money)

This is the reason so many iva companies delay in issuing completion certificates,as any windfalls(regardless of whether you think ppi reclaims is or is not a windfall)can be captured,with a portion going to creditors and another portion going to the slow to act IVA firm!!!!

Iv tried to contact Harrington brookes on so many occasions since my final payment and can't get a straight answer out of anyone! Iv spoke to several people from them about this matter 3 have sad they will get back to me after speaking to the IP and the rest have actually told me to spend it! Madness. My 6 months extension for god knows what ends on 28th December! What happens then? Another extension? Iv paid my dues here I just want it over. Surely 5 and a half years ago it wasn't written in my contract for my iva to be extended to seek ppi claims?

Complain via the internal complaints procedure at harrington brookes!! Its not that hard for the to actually explain whats going on!!

I think I will do that mate! It's 10p a minute as well and always waiting or getting passed on for at least 10 minutes! Absolute nitemare

Nor me mate I was gutted!! When I spoke to this mark dunleavy tho he said don't worry mate ur certificate will be here long before the 6 months is up! Will just have to wait until end of this month and see if my certificate is here by then. Seems crazy having 2 grand in my bank account and I can't touch it!! Luckily after 5 years of not being able to spend I can control myself for now!

Rang Harrington brooks several times again today, get thru to one department who put me thru to another and the phone just rings constantly! Seem to be a bit of a joke firm now, 6 months is almost up and still no certificate no phone calls or letters! Might just drive down to their office!

My thought is that IP firms don't really hang on to cases per se as they don't really benifit from it. There's a maxmimum they can claim over the term that is agreed with the crditors from the onset. If you got a true windfall it goes to the creditors. The creditors are unlikley to give some money back to the IP or the IP get a share of that windfall. This is how my proposal worked, do see check your proposal to see if it worked in a different way, which may mean they are being underhand or then again maybe not. It could be just shabby management of your account!

Well just wait and see wat happens! Not gonna ring them no more! I havnt had to pay for 6 month now and if they gave me an extension for whatever reason then surely my cert should b here by 30/12/11 if that's when it ends? Or will it be after?

I might be wrong, but trying to claim any ppi while your IVA is still not completley 100% finnished seems a bad move to me.
If your IVA company got a sniff of you getting any more money while waiting im sure they are not going to get a move on in finnishing.

I could probley claim quite a bit of ppi but im not intrested in as its not going to go in my pocket!!

I would like to see your company just finnish your IVA for you a.s.a.p as you have done your bit and played it down the line.

Just read the standard terms and conditions can e extended twice once for 6 months and 2nd for 3 months if u do no receive notice no less than 7 days before the end of the term then u are completed ur iva and certificate sent thereafter. Paragraph 5 to 7
