can creditor not aware of IVA sue for repayment

If after an IVA has been agreed with creditors and is in operation, can another creditor which was not counted in assessing the IVA and who was not aware of the IVA arrangement sue for repayment?

Hi nemas,

I think they probably can as not being included in the IVA they will not be bound by it's terms.

This is different to bankruptcy which I think covers all debts whether notified or not.

It sounds as though something went a bit wrong as all your original creditors should presumably have been included in the IVA

Hopefully someone will be a along later to give you a more definitive answer.
