Can I apply for IVA though I am not UK resident?

Hi,

I have loans with UK and Channel Islands banks but am currently resident in the UAE due to work reasons.

Can I still apply for an IVA even though I am not UK resident?

Hi emily and welcome to the forum

You lucky person living and working over there! I bet you don't miss the English weather!

Do you have any form of permanent address in the UK - perhaps your parents, or does all of your mail get sent to you directly? If you do have some form of UK base, it will be possible for you to propose an IVA, but if your residency is permanent in the UAE, then this will be very difficult. Are you working for a government organisation or a private sector company?

Thanks for your reply.

No, I certainly don't miss the British weather, although it does get a little too hot over here in the summer months, even the sea water is too hot to swim in!

I have my mother in the UK and the majority of my post goes to her address and she then forwards it on to me here.

My residency is not permanent in the UAE as it is not possible to do that here, unless you marry a UAE National and I can't see that happening in the future, unless some rich oil sheikh sweeps me off my feet (I can keep on dreaming!).

My residency has to be renewed every three years.

I work for a private sector company here in Dubai.

I definately think that you could use your Mum's address in the UK if you wanted to propose an IVA. I have successfully done this for a number of ex-pats over the last few years, with little difficulty, but of course full disclosure has to be made of the fact that you are living abroad but are retaining British residency.
