Can i be Lasting Power of Attorney for my husband ?

I am 3 years into an IVA< can I be Lasting power of Attorney for my husband who has had to go into a permenant care home

Pretty sure there is no problem with this,but ensure your IP is fully aware at all times.

I think you will be ok but I agree with Paul that you need to inform your IP.

It may depend if the IVA is seen (as it some times as BR) I know this as we have just gone though this for my husband. I was able to act on my husbands behalf because my IVA is almost at the end of the 6 years (Nov.2011) We went to a private company who does this work and people who are BR are not able to act in an EPA. The guy who set ours up said it was to safe guard the person form people who may take their money (which I know is not the case) but it is not unheard of for distant family members to do that.

There would be no problem with you acting in such capacity for your husband.
