Can I Change my Insolvency Company?

Hi there

Another question, are we allowed to change our IP for a different one when part way through the IVA?

You would have to look at the terms of the proposal (including the standard terms), to see if it is possible to change the Supervisor part way through, probably this would require ameeting of creditors to resolve to do it, but it is likely that this would be something that could only be done by the Supervisor him/herself, if, for instance they wished to retire.

If you are dissatisfied with the performance of your Supervisor, then you should complain to him, and if this is not resolved satisfactorily, refer the matter to his authorising authority.

It is very difficult to change your company once in an iva, not impossible, but very difficult. The only time there is a change is if the company stops business and then you are passed to another. Are you having problems with yours ?

Not so much problems, just dont seem to be getting same advice twice, sometimes contradictory depending who I speak to!!!

This seems to be a problem that arises in that one will say one thing and another something else the best thing if you are not happy is to ask to speak directly to the Ip. If they are one of the unreachable then ask whoever you are speaking to to veruify it with the Ip as you have been told conflicting answers. If it is something of importance ask them to send confirmation in writing as well.

It is simply not possible for a debtor to change their IVA provider at their own instigation, without extremely good reasons - and I have personally never seen this done in the 22 years I have been in practice.

Changes of insolvency practitioners only occur if the IP dies, retires, leaves the firm of his employ, or loses his practicing license through malpractice.
