Can i claim ppi money?

Finished IVA 12 months ago got completion letter month later thought all fine but just received ppi payment they sending straight to debt company can they do that after it's all supposed to be final,can i claim money.

Yes they can as it is an asset due to your IVA.

Check your completion certificate as it should say regarding PPI and if this part of the agreement.

It is generally sent to the IP for the creditors.

PPI is an asset that existed during the IVA, albeit unknown about at the time. As such it belongs to the IVA estate. In many cases the IP also gets it assigned before issuing the completion certificate, just to be sure.

If you instructed a claims company to act for you then you could find yourself with a debt to them for their commission. If this is the case you could ask the IP to pay it as a cost before they distribute to creditors which some firms will do.

Even though my IVA finished 13 month's ago the debt company gone into administration who will get my ppi as company no longer exists even though it been sent to them.

Had they gone into administration before issuing your completion certificate ? Your case file could have been passed to another supervisor, who will distribute the money to your former creditors. If not, the money should be returned to you via the issuing creditor. Technically it still belongs to the creditors, but, if there is no way to get it to them via the old IVA, I would argue it should be yours.

Which firms were involved ? Someone might know who cases were transferred to.

I got closure report 12 months ago it's with dfd they went into administration last month

DFD isn't in administration, it has been sold as a going concern to Aperture who are currently running it with the old staff and I assume the old records will go with them. However, it will take some time for everything to be sorted out in the transfer. The parent company, Fairpoint, is in administration.

It might be worth getting in touch with Aperture to see what they intend to do, although I think the answer at the moment will be "wait and see".
